According to the Daily Caller, the San Francisco based 9thCircuit Court “rolled back” a previous decision a federal judge made late on Tuesday night. U.S. District Judge Jon Tigar (Who was appointed by Barack Obama) had reinstated a nationwide ban against President Trump’s planned asylum, but the appeals court ultimately decided to bring the policy back.
President Trump’s asylum ban, which was first introduced back in July, refuses asylum application for immigrants who traveled through a “third” country while on their way to the United States without properly seeking protection status. Specifically, migrants who travel from any southern country into Mexico and requests asylum trying to cross the U.S. Southern border, will be automatically denied application if proper protection request was not documented while traveling through Mexico. U.S. District Judge, Jon Tiger, appointed by Barrack Obama, handed down a “nationwide injunction” against Trump’s new asylum rule in July. After careful consideration, the 9th Circuit Court of Appeals re-entered the judge’s initial rule, concluding the law would only apply within the court’s jurisdiction, which includes California and Arizona. Ultimately, President Trump’s new asylum law could be implemented at the Texas and New Mexico borders.
Judge Tigar’s attempt to halt President Trump’s asylum rule didn’t stop there, Tigar placed another injunction against the “third country transit bar” on Monday. Arguing that migrants would be exposed to a highly complicated and expensive process if the asylum law is not applied consistently throughout the country. Via the Daily Caller.

“The organizations have presented sufficient evidence that they will suffer organizational and diversion of resources harms unless the rule is enjoined outside of, as well as within, the 9th Circuit,” Judge Tigar wrote. “A nationwide injunction is thus ‘necessary to give prevailing parties the relief to which they are entitled.”
President Trump and his administration criticized the U.S. District Judges’ decision on Monday.
“Immigration and border security policy cannot be run by any single district court judge who decides to issue a nationwide injunction,” Said White House press secretary Stephanie Grisham. “This ruling is a gift to human smugglers and traffickers and undermines the rule of law. We previously asked the Supreme Court to set aside the district court’s injunction in its entirety, our request remains pending with the Court, and we look forward to it acting on our request.”

Although Tigar attempted to destroy President Trump’s new asylum rule, the 9thCircuit Court decided to again “roll back” the judges’ decision on Tuesday night, ruling the injunction only applies to the court’s districts. The districts include states like California, Arizona, Montana, Idaho, Hawaii, Guam Nevada, Alaska, Oregon and Washington. The current rule will allow President Trump to launch his “third country” transit rule in southern border states of Texas and New Mexico. Via the Daily Caller.
President Trump and his administration currently seek permission from the Supreme Court to allow his asylum rule to remain in effect while court decisions continue.
